tport.cloud Terms of Service

Last Updated: October 26, 2026

These Terms are an agreement between you and BIZ59 LLC ("we", "us", "our") for the tport.cloud website ("the Site") and the tport.cloud service: virtual servers, shared servers, databases and DNS hosting, ordered and managed in the console at app.tport.cloud ("the Service"). By using the Site or creating an account you agree to them, to the Refund Policy, the Acceptable Use Policy and the Privacy Policy.

1. Accounts

You must be at least 18 and able to make a contract. Keep your sign-in, keys and API tokens safe; you are responsible for everything done with them. If you sign up for a business, you agree for it.

2. Prices and payment

  • tport.cloud is prepaid. You add balance (a top-up) by card through Stripe; we never see your card number. Servers and other services are paid only from that balance.
  • Each server or service costs its listed price for every 30 days. The first 30 days come off the balance when you create it, then every 30 days after that. The order form shows the final price before you confirm.
  • If the balance can't pay the next 30 days, the account is suspended and its servers are stopped. A top-up that covers what is due starts them again. Servers stopped for an unpaid balance for 14 days may be deleted with their data.
  • We may change prices for new orders at any time, and for running services with at least 30 days' notice by email.

3. No refunds

All payments are final and not refundable, in whole or in part, including for months or days not used, accounts closed early, and accounts suspended or closed for breaking these Terms. When you delete a server, the unused days of its current 30 days go back to your tport.cloud balance as credit. Balance is not paid out as money, has no cash value outside tport.cloud and can't be moved to another account. If we charged you by mistake, we correct it. Details: Refund Policy.

4. Acceptable use

You may not use the Service for anything illegal or harmful. The Acceptable Use Policy lists what is not allowed. We may remove content, block access or suspend an account that breaks it, where needed without notice.

5. Your content

You keep all rights to your servers, databases, DNS zones and everything stored or run on them. You give us only the permission needed to store, copy, process and deliver them to run the Service for you. You alone are responsible for your content: that you have the right to store and share it, that it is legal, and what it does. We do not check content before it is stored or published and we are not responsible for content hosted by our customers.

6. Your data and backups

Keep your own backups. We take reasonable care of the Service, but data can be lost, damaged or become unavailable through faults, mistakes, attacks or events outside our control. We are not liable for any loss, corruption or unavailability of data, whatever the cause, to the extent the law allows.

7. Support and fixes

We make a best effort to fix problems and answer support requests at support@biz59.net, but we do not promise a response time, a fix time or a level of uptime unless a separate written agreement says so. Maintenance and short interruptions can happen.

8. Information shared with authorities

We share information about an account, its users and its content with law enforcement and other public authorities in the customer's jurisdiction and in ours (the United States and the State of New York) when we receive a valid legal request (such as a subpoena, court order or warrant), when the law requires it, or when we believe in good faith that it is needed to prevent harm to a person or to stop illegal activity on tport.cloud. Where the law allows, we tell the customer before we share.

9. Suspension and closing

You can close your account at any time in the console at app.tport.cloud or by writing to us. We may suspend or close an account that breaks these Terms, doesn't pay, puts the Service or others at risk, or when the law requires it. When an account closes, its content may be deleted.

10. No warranty

The Site and the Service are provided "as is" and "as available", without warranties of any kind, including fitness for a purpose, uninterrupted or error-free operation, and security.

11. Limitation of liability

To the extent the law allows, BIZ59 LLC is not liable for indirect, incidental, special or consequential losses, lost profits, lost revenue, or lost or damaged data or content, even if told they might happen. Our total liability for any claim is limited to the amount you paid us for the Service in the 3 months before the claim.

12. Indemnity

You will cover BIZ59 LLC against claims, costs and fines that come from your content, your use of the Service, or your breach of these Terms or the law.

13. Changes

We may change these Terms. We update the date at the top and, for changes that matter to paying customers, email them at least 30 days before. Using the Service after that means you accept them.

14. Law

These Terms are governed by the laws of the State of New York, USA. Courts in New York County, New York, decide any dispute, unless the law where you live gives you a right to go to your local courts.
